PRESENTATION

The %u201CMáster University in Environmental Right and of the Sustainability%u201D (MADAS) of the University of Alicante is an Official Title of Máster, adjusted to the disposals of the Royal decree 1393/2007, of 29 October, by which establishes the ordination of the university educations officials, and of the own Rule of the University of Alicante for the official titles of Máster and Doctorate, approved by the Council of Government on 31 October 2008 (BOUA of 6 November 2008); and adapted, in consequence, to the exigencias of the European Space of Upper Education.

His Plan of Studies, that received the Report of favourable Evaluation by part of the ANECA in date of 22 March 2010, and began to give from the academic course 2010-2011, consists of 60 credits ECTS, developed in an alone academic course.

In accordance with the before indicated rule, the Máster University in Environmental Right and of the Sustainability (MADAS) constitutes, besides, the period of training of the Program of Doctorate of the same name of the University of Alicante.

Antecedents

The University of Alicante explains already with a long experience in the teaching of titles of postgrado of similar characteristics to the present, initiated with %u201Cthe Program of Doctorate in Environmental Right%u201D and continued with %u201Cthe Máster Official in Environmental Right and of the Sustainability (MADAS)%u201D, whose path can resumir as follows:

To) Program of Doctorate in Environmental Right

The valid %u201CMáster University in Environmental Right and of the Sustainability (MADAS)%u201D has his origin in the pioneering %u201CProgram of Doctorate in Environmental Right" of the University of Alicante, whose first edition took place in the academic course 1988/1989, to the protect of the rule of third cycle established by the Royal decree 18571985, of 23 January, happening afterwards to integrate during a series of courses in another program of doctorate of content wider, one of whose main matters kept on being the environmental Right.

After this first stage, the %u201CProgram of Doctorate in Environmental Right" of the University of Alicante recovered his character of autonomous program, already without solution of continuity, in the academic course 1993/1994, still under the diet of third cycle established in the Royal decree 185/1985, of 23 January, initiating then during some years the double modality of ordinary course and intensive course, what allowed the progressive incorporation to the Program of students Spanish Americans.

In the academic course 1999/2000 went in in force the new diet of the third cycle established by the Royal decree 778/1998, of 30 April, what forced to unfold the plan of studies of the Program of Doctorate in a first course of teaching and a second course headed to the realisation of the work of sufficiency researcher, that culminated with the obtaining of the Diploma of Studies Advanced (DEA). On the other hand, and already under the force of this new regulation, from the academic course 2000/2001 the %u201CProgram of Doctorate in Environmental Right%u201D of the University of Alicante happened to explain during some years with two groups, one in Alicante and another in Mexico, thanks to an agreement in this sense with the Autonomous University of Mexico (UAM).

B) Official program of Postgrado and Máster Official in Environmental Right and of the Sustainability (MADAS)

From the academic course 2006-2007, the mentioned Program of Doctorate was substituted by the new %u201COfficial Program of Postgrado in Environmental Right and of the Sustainability%u201D of the University of Alicante, adapted to the forecasts of the Royal decree 56/2005, of 21 January, by which regulate the official studies of postgrado, and whose implantation was authorised by Resolution of the General Direction of University and Upper Training of the Generalitat Valencian (DOGV no. 5.270, of 31 May 2006); program composed by a Máster, the %u201CMáster Official in Environmental Right and of the Sustainability%u201D (MADAS), and a Doctorate with lines of own investigation.

The Plan of initial studies of the Máster had 60 credits ECTS, developed in an alone academic course, although from the course 2007-2008, and in virtue of a modification of the same, happened to have 72 credits ECTS and to realise in two academic courses. The new Plan of Studies that began to give in the course 2010-2011 retells, as it has indicated further up, with 60 credits ECTS, developed in an alone academic course

A specific Agreement of international university collaboration between the University of Alicante and the University of the Valley of Itajaí (UNIVALI) of Brazil, concerning the MADAS and to the Course of Post-Degree Strictu Sensu in Juridical Science of this second, has facilitated during these last years to students of both programs of postgrado the obtaining of the title offered by the another University by means of the reciprocal recognition of until a 50 by 100 of the educational credits of the respective plans of studies.

CRITERIA OF ADMISSION

Requirements of admission: The generals for the access to official educations of Máster, according to the article 16 of the Royal decree 1393/2007. The foreign students no pertinent of countries of Spanish speech will have to accredit, besides, the possession of at least a level B1 of command of the Spanish or Spanish (level threshold or threshold), in the clear-cut terms by %u201Cthe Common European Framework of Reference for Languages%u201D(MCER).

Criteria of assessment of merits:

1) Degree (until 4 points). Will have greater punctuation the applicants with degree in Right.

2) academic File and skilled training in environmental Right or in environmental protection (until 6 points).

3) Activity researcher and professional experience in environmental Right or in environmental protection (until 4 points).

4) Expectations of training (until 4 points)

5) Knowledge of languages and other merits (until 2 points).

Total maximum punctuation: 20 points.

Minimum punctuation required: 10 points

Number of squares again entry: 20

AIMS

General aims of the Máster:

  • Offer to the student a training advanced, of skilled character,theoretical and practical, systematic, complete and interdisciplinar in matter of environmental Right, with a polyvalent functionality, susceptible to be taken advantage of so much in the exert of the distinct juridical professions or related with the environmental protection as in the field of the investigation.
  • Form researchers in the field of the environmental Right, providing them for this the knowledges, stimuli and the necessary methodological tools.

General competitions of the Title:

  • Knowledge of the main institutions of the environmental Right and capacity to apply it to the solution of real problems.
  • Capacity to interrelate the distinct plots of the environmental Right and resolve juridical problems-environmental complexes.
  • Capacity to analyse críticamente the legislation and environmental jurisprudence and formulate trials in the matter that include, in his case, reflections on the social and ethical responsibilities linked to the application of the same.
  • Capacity to identify the work of the jurist in the resolution of environmental problems, obtain, comprise and appreciate the informations and pertinent conclusions of other knowledges (ecology, environmental economy, etc.) and integrate them inside the juridical analysis, and value the work interdisciplinar.
  • Capacity to communicate the conclusions reached on juridical subjects-environmental, and the knowledges and reasons last that the sustentan, to skilled publics and no specialised of a clear way and without ambiguities.
  • Possession of skills of learning to continue studying the thematic juridical-environmental of a way to a large extent autodirigido or autonomous.
  • Command of the methodology and the own formal appearances of works of investigation on juridical subjects-environmental.
  • Capacity to draft of clear form, honest and systematic a work of investigation in juridical matter-environmental.
  • Sensitivity to the environmental problems from an ethical position based in the respect to the fundamental rights.
  • Motivation for the participation in activities of continuous learning related with the protection of the environment.

Mobility of the students with UNIVALI (Brazil)

Between the University of Alicante and the University of the Valley of Itajaí (UNIVALI) of Brazil exists an Agreement mark of collaboration signed in the year 2005, to the protect of the cual have signed afterwards two specific Agreements of collaboration, valid and notable for our Máster, tending to facilitate the exchange or mobility of students between both Universities. The first, signed in the year 2006, refers specifically to the "Máster University in Environmental Right and of the Sustainability" (MADAS) of the first and to the "Máster in Juridical Sciences" of the second, and recognises to the students of both Másteres that wish cursar the another the right to obtain the recognition or validation of the half of the educational credits of the second. The second, signed in the year 2009, of scope more general, regulates the programs of exchange of students between both Universities, recognising reciprocally the right of the included students in said programs to the exemption of the payment of taxes in the University of destination.

To the protect of the mentioned Agreements, from the course 2006/2007 until the course 2011/2012, have cursado the MADAS a total of 18 pertinent students of the "Máster in Juridical Sciences" of UNIVALI; and they have cursado this last, a total of 20 pertinent students of the MADAS.
