Frequent questions and answers of the law of access to the legal profession

  • What is the legal framework for access to the bar and the search?

%u2022 Act 34/2006 of 30 October, on access to the professions of lawyer and Attorney of the tribunals last on the final disposition third of Royal Decree-Law 5/2012, of 5 March, of mediation in civil and commercial matters in his third final provision

%u2022 Royal Decree 775/2011, of 3 June, which approves the regulation on access to the professions of lawyer and Attorney.

  • How does it affect the application of the rule?
  1. Students enrolled in the degree in law prior to October 31, 2006. (students enrolled in the 2006-2007 academic year).

    These students them isn't enforceable the title of lawyer or Attorney, but they must colegiar within two years since completion degree, as practising or not practising. They are exempt provided that completion of the degree course, not in the case that have completed his studies as a graduate by having transferred his studies to the new plan of the degree in law

    In this situation there are also the students in the program of simultaneous studies of law and ADE (DADE) enrolled in the year 2006-07.
  2. Students enrolled in degree in law subsequent to October 31, 2006. That is, those enrolled in courses 2007 / 2008, 2008 / 2009 and 2009 / 2010.

    %u2666 these students are required the professional title of lawyer and Attorney for power colegiar, but only to do so requires:

    -The period of practices referred to in article 6 of the law of access (30 credits)

    - and the conduct of the review that accredits vocational training.

    %u2666 exempt them from the formative period of 60 credits.

    %u2666 this section needs a regulatory development determined by both the approval of the practical period as that clarify the dates and contents of the review.

  3. However, popular in the Congress parliamentary group has tabled an amendment to the draft law on mediation in civil and commercial matters that adds a second transitional provision to the law on access to the legal profession, in virtue of which who concluded their studies during the 2011-2012, could prove the requirements to obtain the titles of advocate or Attorney through a certificate of achievement and exploitation of a period of practices of at least 300 hours, awarded by the Professional Association to organize. In the case of adoption of this amendment, to graduates who completed their studies during the 2011-2012 and perform the above-mentioned period of practices, is them exempt from the obligation to perform the exam that certifies the vocational training.

  4. Students enrolled in the degree in law and the simultaneous studies programme of the degrees in law and business administration and management

%u2666 Unchanged for them the requirements of the law on access to obtain the title of lawyer and solicitor:

%u2666 formative period of 60 credits

%u2666 practices 30 credits

  • What will make the University of Alicante to adapt to this change?

%u2022 Law school along with the illustrious College of lawyers of Alicante has designed a master's degree in legal practice, which has already obtained the verification of ANECA and is awaiting approval by the autonomous region. He is a Master of 90 credits, which includes the 60 credits from the formative period, not only how the contents of the profession of lawyer that can serve for the preparation of the training test. In addition, this program provides 30 credits of practices organized and approved by the College of lawyers of Alicante. This Master is offered from the academic year 2012 / 2013.

%u2022 In addition, the Faculty of law of Alicante and the law faculties of the Valencian public universities along with the illustrious schools of procurators of Alicante, Elche, Castellón and Valencia are pending verification by ANECA and authorization by the autonomous community of an Inter-University Master in search of 90 credits, which includes the 60 credits of the formative periodnot only to form the contents of the profession of Attorney that you can serve for the preparation of the training test. The Master also includes 30 credits of practices organized by the College of procurators of Alicante. This Master, once accredited and verified, is intended to implement in the year 2012 / 2013.
